Space Host Agreement
This agreement is between the business or individual named in your business profile ("the Host", "you") and Trade By Barter Network, Inc. ("TBBN", "we", "us"). It applies when you enable a location as a TBBN Space and offer services there. It supplements the Business Profile Agreement and the TBBN Terms of Service.
1. What TBBN provides
- A listing for each Space you enable, shown on space.tbbnetwork.com, in the marketplace, and through the Space API, with your prices, hours, and the services you offer.
- Booking and payment: guests book and pay through TBBN before the booking is confirmed. You are notified only once payment has cleared.
- Drop-off and pickup handling: a unique code for each drop-off and each pickup, so you can confirm who is handing over and who is collecting an item.
- Weekly payouts to your connected account of everything owed to you, less our commission, on the published schedule.
- A monthly statement of bookings, commission, and payouts.
2. What you must provide and maintain
- A safe, accessible location that matches its listing: the address, opening hours, capacity, and the services you say you offer.
- Someone present during your listed hours to receive guests and, where you offer it, to accept and hand over items using the codes TBBN provides.
- Reasonable care of any item you hold for a guest, from the moment you confirm its drop-off until the moment you confirm its pickup.
- A connected payout account in the name of your business, or in your own verified name for an individual profile.
- Compliance with local law, including any permits, insurance, and tax obligations that apply to your premises and to the services you offer.
3. Bookings
- A confirmed booking is a commitment to provide the listed service at the booked time. If you cannot honour a booking, cancel it as early as possible through TBBN; the guest is refunded in full.
- Cancellation by guests follows the policy you select for each Space. Refunds are issued by TBBN according to that policy.
- You may not ask a guest to pay you directly for a service booked through TBBN, or to book outside TBBN a service listed on it.
4. Items held for drop-off and pickup
- Confirm a drop-off only when you have the item, and a pickup only when you have handed it to the person presenting the pickup code.
- Hold items securely and for no longer than the period listed for your Space. TBBN will tell you when a hold period is ending.
- If an item is lost or damaged while in your custody, you are responsible to the guest for it up to the value the guest declared at booking. Do not accept items you are not prepared to hold on those terms.
5. Fees
TBBN's commission on each booking is shown when you set your prices and on every statement. Guests pay TBBN; TBBN pays you the balance. Amounts are paid weekly on the published schedule to your connected account. We give at least thirty days' notice of commission changes.
6. Conduct and reviews
Guests may review your Space after a completed booking. You may respond. You must not offer anything in exchange for a review or attempt to remove honest reviews. We may remove a listing that repeatedly fails to match its description.
7. Suspension and termination
You may disable a Space at any time; bookings already confirmed must be honoured or cancelled with a full refund to the guest. We may suspend a Space where we reasonably believe it is unsafe, misrepresented, or used in breach of this agreement, and we will tell you why unless the law prevents us.
8. Liability
TBBN provides the booking service and is not the operator of your premises. We are not liable for injury, loss, or damage occurring at your Space except where caused by our own negligence. To the extent permitted by law, our liability to you under this agreement is limited to the commission you have paid us in the twelve months before the claim.
9. Changes and governing law
We may update this agreement on thirty days' notice; you will be asked to accept the new version before enabling a new Space or continuing to take bookings. This agreement is governed by the laws of the State of Delaware, United States.
