Business Profile Agreement
This agreement is between you and Trade By Barter Network, Inc. ("TBBN", "we", "us"). It applies when you create or maintain a business profile on TBBN, whether as a registered legal entity or as an individual operating as a business. It supplements the TBBN Terms of Service, which continue to apply.
1. What TBBN provides
- A business profile that identifies your business to other participants on the network, with a verification status shown wherever your profile appears.
- The ability to add locations (branches), invite team members with scoped roles, and enable services offered under this profile — Space hosting, and merchant integration where eligible.
- Review of your profile by TBBN staff, and a decision within a reasonable time, typically five business days.
- Payments for services you provide through TBBN, collected by TBBN on your behalf and paid out to the bank account you connect, on the published payout schedule.
2. What you must provide and maintain
- Accurate business details: the legal or trading name, address, country, and the identity of the person submitting the application. You must keep these current.
- A verified identity for the person submitting the application, where identity verification is available in your country.
- A connected payout account in your business's name (or, for an individual profile, in the name of the verified person) before the application can be submitted.
- Compliance with the laws that apply to your business, including tax, consumer protection, and any licensing your activities require.
3. Verification and status
Verification is based on the information you provide and on checks performed by our payment partner. We may ask for additional documents. We may decline, suspend, or withdraw verification if information is inaccurate, if checks fail, or if activity under the profile breaches this agreement or the Terms of Service. Verification is a status shown to other participants; it is not a warranty by TBBN about your business.
4. Eligibility for services
Some services depend on where your business operates. Merchant accounts may be created only by verified registered businesses. Space hosting, payments, and payouts are enabled per country as they become available; your profile shows which services are available to you.
5. Fees
Fees are published at tbbnetwork.com/pricing and in the agreement for each service you enable. We give at least thirty days' notice of fee changes. Amounts we owe you are paid weekly on the published schedule, less any fees due to us.
6. Data
We use the information in your profile to operate the service, to verify your business, and to show other participants what they need to decide whether to deal with you. Our Privacy Policy describes this in full. Personal data of your team members and customers that you provide to us is processed on your instructions for those purposes.
7. Suspension and termination
You may close your profile at any time from account.tbbnetwork.com; obligations already incurred, including amounts owed either way, survive closure. We may suspend a profile where we reasonably believe it is being used in breach of this agreement, unlawfully, or in a way that puts other participants at risk, and we will tell you why unless the law prevents us.
8. Liability
TBBN provides the platform on which you and other participants deal with each other. We are not a party to those dealings and do not guarantee any participant's performance. To the extent permitted by law, our liability to you under this agreement is limited to the fees you have paid us in the twelve months before the claim.
9. Changes
We may update this agreement. Material changes take effect thirty days after we notify you, and you will be asked to accept the new version before submitting a new application or enabling a new service. Continued use after the effective date is acceptance for services already enabled.
10. Governing law
This agreement is governed by the laws of the State of Delaware, United States, and any dispute will be resolved in its courts, without prejudice to consumer protections that apply where you are.
